1. Purpose
These Terms of Service (the "ToS") define the conditions for the provision and use of the AgentFend service, a cybersecurity tool specialized in technical analysis and security scoring for "AI Skills," prompts, scripts, and code repositories related to artificial intelligence.
2. Acceptance
By using the AgentFend website, API, or CLI, you fully and unreservedly accept these ToS. The user declares to be of legal age and to possess the legal capacity or necessary authorizations to bind the organization they represent.
3. Service Access
AgentFend is an evolving service accessible via web browser and command-line interface (CLI) tools. The publisher reserves the right to suspend or restrict access to the service in the event of abusive use, quota exceeding, or any attempt to undermine the integrity of the detection system.
4. Nature of Service and Analysis Limitations
The user expressly acknowledges that the service provides an automated technical analysis based on static rules and heuristics. Consequently:
- Infallibility: AgentFend does not guarantee the total absence of danger. The service may generate false positives (erroneous alerts) or false negatives (undetected threats).
- LLM Independence: The analysis pertains to the submitted technical content. The publisher shall not be held liable for behaviors, errors, or damages generated by a third-party Large Language Model (LLM such as Claude, GPT, etc.) following the execution of content analyzed by AgentFend.
- No Certification: A high score or a "Safe" badge constitutes a technical indicator and not a legal certification or a guarantee of absolute harmlessness.
5. Obligations and Prohibitions
The user agrees to submit only content that they are legally authorized to handle. The following are strictly prohibited:
- Reverse Engineering: Attempting to decompile or extract the internal logic of the analysis engine (Onyx Engine).
- Anti-Fuzzing: Using the service in an automated manner to test variants of malicious code for the purpose of identifying and bypassing detection rules. Any suspicious behavior of this type may result in the immediate suspension of the account without notice.
6. User Responsibility
The user remains solely responsible for the decision to install, execute, or deploy the analyzed content.
Security Warning: The analysis provided by AgentFend does not exempt the user from executing suspicious scripts in an isolated environment (Sandbox). The publisher declines all liability for system compromise resulting from the execution of content after its analysis.
7. Intellectual Property
All algorithms, scoring methods, interfaces, and documentations are the exclusive property of the publisher.
- Right to Share: The user is granted a non-exclusive right to share AgentFend scan reports and scores, provided that the data is not altered and the service mentions are maintained.
8. Personal Data and GDPR
In accordance with the General Data Protection Regulation (GDPR):
- Legal Basis: Data processing is necessary for the performance of the user contract.
- Retention: Files and scripts submitted for analysis are retained for a maximum of 30 days (unless a request is made to add them to the public library by the user).
- Security: No sensitive data (detected API keys, secrets) is stored persistently after the generation of the final report.
- Rights: Users have the right to access, rectify, and delete their personal data, which they can exercise by contacting the publisher at the email address provided above.
9. Limitation of Liability
The publisher shall not be held liable for indirect damages, data loss, or business interruptions. Should the publisher's liability be engaged, it shall be strictly limited to the amount paid by the user for the service over the past twelve (12) months, or failing that, to a flat sum of 100 euros.
10. Evolution and Pricing
The publisher reserves the right to make certain features paid. Any substantial price modifications will be notified to the user with 30 days' notice. Continued use of the service after this period constitutes acceptance of the new rates.
11. Governing Law and Jurisdiction
These ToS are governed by French Law.
- B2B: For users acting in a professional capacity, exclusive jurisdiction is granted to the courts of Orléans (45), France.
- B2C: For consumers, legal jurisdiction rules apply (the court of the defendant's domicile or the place of delivery/performance).
